Kuwaiti labor law allows union membership primarily for Kuwaiti nationals and places limitations on the formation of unions in certain sectors. We respect these legal constraints while ensuring that all employees—regardless of nationality or job status—have access to alternative, legitimate forms of representation in line with SA 8000.
2. Establishing Worker Representation Mechanisms
In place of formal trade unions, we have implemented parallel means of worker representation, a concept endorsed by SA 8000 Certification services in Kuwait. These include:
- Elected worker representatives in each department or worksite
- A cross-functional Worker Committee, composed of representatives from different nationalities and roles
- Inclusion of worker representatives in the Social Performance Team (SPT), which oversees SA 8000 compliance
These structures allow employees to raise collective concerns, suggest improvements, and participate in decision-making related to working conditions, safety, wages, and well-being.
3. Election and Participation Process
The election of worker representatives is carried out through a free, fair, and confidential process. All employees, regardless of nationality or position, are eligible to vote and stand for election. Regular meetings between the Worker Committee and management ensure an ongoing dialogue. Issues raised are documented, reviewed, and addressed in a transparent manner.
4. Training and Awareness
All employees receive training on freedom of association, worker rights under SA 8000, and the available representation structures. These sessions are multilingual and tailored to the literacy levels and cultural backgrounds of our diverse workforce.
Managers and supervisors are also trained to respect the right to collective voice and are prohibited from retaliating or discriminating against workers for participating in representation activities.
5. Grievance Mechanisms and Oversight
In addition to worker representation, our grievance mechanism provides an individual channel for employees to raise issues confidentially. This ensures that all workers—regardless of whether they are part of a group—can speak up without fear.
